These Terms of Use govern your access to and use of the Smile Denture & Implant Clinic website (the "Site"). By using the Site you agree to these Terms. If you do not agree, do not use the Site.
1. About us
Smile Denture & Implant Clinic is a denturist practice. Denturists in Ontario are regulated health professionals governed by the *Regulated Health Professions Act, 1991*, the *Denturism Act, 1991*, and the College of Denturists of Ontario.
2. Informational purpose only — no professional relationship
The Site, including its service pages, blog, CDCP estimator, and the Smiley assistant, provides general information for educational purposes only. It is not professional, clinical, or medical advice, and your use of the Site does not create a denturist–patient or any other professional relationship. Always consult a licensed denturist about your situation. See our Disclaimer. In an emergency, call 911.
3. Coverage, estimates, and pricing
Any information about CDCP or insurance coverage, the CDCP estimator, pricing, or financing is general and illustrative only and depends on your eligibility and treatment plan. Coverage and costs are confirmed with you in writing before treatment.
4. Acceptable use
You agree to use the Site lawfully and not to: interfere with or disrupt it; attempt unauthorized access; misuse the forms or chat assistant; or submit false, misleading, or unlawful information.
5. Intellectual property
The Site and its content — text, design, logos, icons, and graphics — are owned by Smile Denture & Implant Clinic or its licensors and are protected by law. You may not copy, reproduce, or reuse them without our prior written permission. Third‑party marks (e.g., regulatory and association logos) remain the property of their owners.
6. The Smiley assistant
Smiley is provided "as is" to assist with general questions and booking. It may be unavailable, incomplete, or inaccurate and must not be relied upon for clinical or financial decisions.
7. Disclaimers
To the fullest extent permitted by law, the Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied. **Nothing in these Terms limits or excludes any right, warranty, or remedy that cannot be limited or excluded under the *Consumer Protection Act, 2002* (Ontario) or other applicable law.**
8. Limitation of liability
To the fullest extent permitted by law, Smile Denture & Implant Clinic and its personnel are not liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of, or inability to use, the Site or its content. Nothing in this section limits liability for personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under Ontario law.
9. Indemnity
You agree to indemnify Smile Denture & Implant Clinic against claims and costs arising from your misuse of the Site or breach of these Terms, to the extent permitted by law.
10. Third‑party links
We are not responsible for the content or practices of websites we link to.
11. Privacy
Your use of the Site is also governed by our Privacy Policy.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. You agree to the exclusive jurisdiction of the courts of Ontario, subject to any non‑waivable consumer‑protection rights.
13. General
If any provision is found unenforceable, the remainder continues in effect (severability). Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us regarding the Site.
